Brockport may be facing another law suit

Saying the Brockport Village Board should compensate him for his December censure, Trustee Peter DeToy said he intends to sue.

A notice of claim was filed with the village clerk’s office by DeToy. In addition to the village, Mayor Josephine Matela and Village Trustees Norman Knapp, Morton Wexler and James Whipple are named in the suit.

The censure resolution that was passed against DeToy on December 17 prohibited him contacting any village employee as long as he remained a village board member.

Claiming the village had acted illegally and improperly and had violated his rights, DeToy went to court over the resolution.

The notice of claim, filed March 14, states that DeToy suffered defamation of character, humiliation, embarrassment, stress, anxiety, sleeplessness and legal and other expenses as a result of the censure.

Phone calls allegedly made by DeToy to a village emergency services dispatcher in December prompted the censure by board members. In the recorded phone conversations, DeToy allegedly threatened members of the police department over an incident involving his son, Michael. Michael is a member of the Brockport Police Department and was on leave at the time of the incident.

DeToy later sent a letter of apology to the village board that stated, in part, that family illness clouded his judgment when he was speaking to the dispatcher.

Matela said there have been no further developments at this time.
