State tax evaders are getting an opportunity to pay up with no penalties and reduced interest under an amnesty program designed to help balance this year's budget.

Now, for the first time, individuals can apply for amnesty and pay their balance on-line by visiting http://www.nystaxamnesty.com. A computerized calculator will display how much they are saving in penalties and interest. Individuals may also apply by dialing (888) 552-3453 from 8 a.m. until 7:30 p.m., Monday through Friday. Call (800) 748-3676 to receive a fax copy of the application. Use the amnesty fax transmission code: 17097.

This year's tax amnesty program began November 18 and will last until January 31, according to Assemblymember Susan John, who, along with her colleagues in the state legislature authorized the program in the 2002-03 state budget. According to the New York State Department of Taxation and Finance, this program is expected to bring in $175 million in delinquent and disputed taxes. It has been several years since the state has offered to forgive interest and penalties due on unpaid taxes.

"This amnesty program provides an incentive for those who have fallen behind in their taxes to pay up without having to worry about extra fees," said John, whose district includes Chili, Riga, Wheatland and Rush. "This is an excellent opportunity for people to step forward, pay their state taxes, and remove the emotional burden of owing the state from hanging over their heads."

Individuals and businesses with fewer than 500 employees are eligible to apply for amnesty for tax periods ending prior to January 1, 2001. Anyone who received tax amnesty when the state offered it in the past is ineligible to apply this year, as are those whose liabilities are under criminal investigation on pending criminal litigation. Schools and other local taxes are not covered under this amnesty.
